What is HR management?

Human resource management deals with the human resources of a company. It is not about the person as a worker per se, but the skills, knowledge or motivation of the individual employee.

What is a collective agreement or collective wage?

The collective wage is the wage negotiated between the employer and the union. It is laid down in the collective agreement and describes the minimum salary that an employee can expect, adjusted to his or her professional qualifications. In addition to the standard salary, the collective agreement also contains all the rights and obligations that apply to the relationship between employer and employee. The collective wage or the collective agreement is always valid until it is renegotiated by both parties, employers' association and union.

What is an employee contract?

If a company has decided to use flexible personnel as part of personnel leasing, it commissions a personnel service provider. The basis for the cooperation between the personnel service provider and the customer company is always an employee leasing contract concluded before the start of the assignment.

What are the risks for a company?

Basically, there is a risk of subsidiary liability. This means that the customer company may be liable for social security contributions (§ 28e SGB IV), contributions to the employers' liability insurance association (§ 150 SGB VII) and wage tax (§ 42d EStG).

What is the difference between personnel leasing and recruitment?

With personnel leasing, a personnel service provider such as Personalis leases personnel to customers for a limited period of time. The employment contract is concluded between Personalis and the personnel leasing employee. However, the employee works on-site at the client company on a rotating basis and for a limited period of time.

When a company has a vacancy to fill, it can either use its own human resources department or hire a recruitment company, such as Personalis, to handle the recruitment process. The underlying principle in this case is permanent placement. The applicant concludes the employment contract directly with the company. Personalis merely acts as an intermediary.
